Non-discrimination and citizenship of the Union

Students should have at least basic knowledge of the functioning of the European Union and have a good understanding of English as well as the ability to write in English.

This course aims at empowering students to understand and critically analyze the EU rules on Union citizenship and non-discrimination, in particular the relevant treaty provisions, directive 2004/38 and the CJEU’s abundant case law. The course focuses on EU citizens’ rights of free movement, residence and equal treatment in the host member state, as well as the rights of their family members. The treaty provisions and rules of secondary legislation, as well as their broad reading by the CJEU, are of fundamental importance to understanding the various developments of citizens’ rights and guarantees under EU law: for example with regards to questions of extradition to a third country, loss of nationality of an EU Member State and thus loss of Union citizenship, etc. Furthermore, the course will give insight into political rights granted to EU citizens.
