Objectifs

The South American legal systems are becoming increasingly relevant, in
particular as they develop their own ways of interpreting and applying constitutional and
human rights. In this scenery, the aim of the course is to provide a panorama of the South
American legal systems from a socio-legal perspective with emphasis in constitutional
law. Following a historical background from the colonization to the constitutional
organization of the South American countries, relevant topics related to human rights
adjudication will be addressed and discussed.


Présentation

The course will present the common
threads as well as the individual and distinctive features of the South American legal
systems. The students should then be able to identify the adequate generalizations
resulting from the common legal heritage, whilst being aware of the main differences in
structure and content that make each country unique. The course should provide students
with the necessary tools to understand diverse legal settings and to critically analyse legal
solutions with a dialogical approach.

Session 1 –
1. Presentation of the course and introduction – Colonial Background.
2. Peculiarities of Brazil within the South American Group.
3. Constitutional Background: Hard Democracies and Soft Dictatorships.

4. The Inter-American Court of Human Rights and the New Constitutionalism
5. Selected Topics 1: Domestic and International Human Rights Law

Session 3
6. Selected Topics 2: Indigenous Rights and Environmental Rights

Session 4
7. Selected Topics 3: Citizenship and Equal treatment

8. Selected Topics 4: Freedom of Expression

Modalités

Modalités d'enseignement

The course will be based on lectures that will highlight the main issues of
the sessions’ subject and complement the reading materials.
Students are expected to read the materials in advance and to actively participate in each
session by, either presenting and discussing, or only discussing issues related to the
proposed topic.

Assessment: The assessment will comprise in-class interventions + written report + final
exam.
